Digital marketing and PPC agencies in the UK: the cookie, email and advertising rules a good agency builds in
UK digital marketing runs under the ICO's cookie and email rules, the CAP Code and the DMCC Act 2024, so the agency worth hiring builds those into the account rather than fixing them after a complaint.

A UK digital marketing or PPC agency is judged on two things: whether it gets you customers at a cost you can afford, and whether it does so inside UK rules. Those rules are specific. The ICO says ad tracking needs consent, PECR limits marketing emails to individuals, the CAP Code requires evidence for claims and labels on paid posts, and the DMCC Act 2024 bans fake reviews. Ask any agency how it handles each one, keep the ad accounts in your own name, and compare quotes on the same written brief.
What "digital marketing services" covers in the UK
The phrase covers several different jobs, and most UK agencies are strong at one or two of them.
| Service | What it does | Who usually sells it |
|---|---|---|
| PPC (paid search) | Ads on Google and Microsoft Bing, paid by the click | PPC specialists and full service agencies |
| Paid social | Ads on Meta, TikTok, LinkedIn, Pinterest and others | Paid social agencies, performance agencies |
| Organic social | Posting, video, community and creator work | Social media marketing companies |
| SEO | Organic search visibility | SEO agencies and consultants |
| Email and CRM | Newsletters, automated emails, customer data | Email specialists, ecommerce agencies |
| Content | Articles, guides, video and data that people seek out | Content agencies, PR firms |
"Performance marketing" usually means paid channels managed against a target such as cost per sale. It is a way of working, not a separate channel. For SEO in particular, see how to hire an SEO company in the UK.
PPC agencies in the UK: four decisions that matter
1. Who owns the account
The Google Ads and Microsoft Advertising accounts should be in your company's name, with the agency given access. The account holds your history: keywords, costs, conversions and tests. If the agency owns it, you lose that when you leave.
2. Where the ads show
Google Ads lets you target countries, areas within a country or a radius. Its default setting reaches people in your locations and people who have shown interest in them. Google's help page says to consider "Presence" targeting when you only serve people physically in the area. A UK wide online shop and a plumber in Leeds need different settings.
3. The UK calendar
The UK does not have one set of bank holidays. GOV.UK lists different dates for England and Wales, Scotland and Northern Ireland. In 2027, for example, Scotland's summer bank holiday is on 2 August and England's on 30 August, and Northern Ireland adds St Patrick's Day and the Battle of the Boyne holiday. If your ad schedule and budgets change on holidays, set them by nation.
4. Prices in ads
CAP Code rule 3.18 says quoted prices must include non optional taxes, duties, fees and charges that apply to all or most buyers. VAT exclusive prices are allowed only where everyone the price is aimed at pays no VAT or can recover it, and then the amount or rate of VAT must be stated prominently. That applies to ads, shopping feeds and landing pages.

Cookies and tracking: the ICO's 2026 guidance
The ICO finalised its guidance on storage and access technologies on 29 April 2026, after two public consultations on the draft. Three points matter for any UK agency running ads.
- Advertising needs consent. The ICO says using storage and access technologies for online advertising requires consent, both for ad selection and delivery and for any tracking and profiling.
- Measurement does not need a separate consent. The ICO says advertising measurement does not require a separate consent.
- Some analytics is exempt. A "statistical purposes" exception covers collecting information about how your website is used to improve it, as long as you give clear information and a simple, free way to object. The ICO says it is not a broad exception for every analytics tool.
Ask the agency to show you how your cookie banner, your ad tags and your analytics fit together. If they cannot explain it, the tracking behind every report they send you is in question.
Email marketing: PECR
The ICO's guidance on electronic mail marketing says you must not send marketing emails or texts to individuals without specific consent. There is a limited exception for your own previous customers, the soft opt in, which needs a clear chance to opt out when you collect their details and in every message. It does not apply to bought in lists. You can send marketing emails to companies, and the ICO calls it good practice to keep a do not email list of companies that object. Any agency that offers to send email to a list it supplies should explain how that list meets these rules.
Social media marketing companies in the UK
A UK social media agency will run organic accounts, paid social, creator partnerships or all three. The rules that apply to all of them:
- CAP Code rule 2.1: marketing communications must be obviously identifiable as such.
- CAP Code rule 2.3: they must make their commercial intent clear if it is not apparent from the context. The ASA notes this reflects a prohibited practice in Schedule 20 of the DMCC Act.
- CAP Code rule 3.45: marketing must make clear where consumer reviews have been incentivised.
So a paid or gifted creator post must be labelled as an ad. Our guide to advertising standards in the UK explains what the ASA can do when a rule is broken.
Reviews and claims: the DMCC Act 2024
Schedule 20 of the Digital Markets, Competition and Consumers Act 2024 lists commercial practices that are always unfair. Paragraph 13 bans submitting or commissioning fake consumer reviews, or reviews that conceal that they were incentivised, and requires those who publish reviews to take reasonable and proportionate steps to prevent and remove them. It also bans offering services to traders to do those things. Paragraph 12 bans paid editorial that is not clearly identified. Both have been in force since 6 April 2025 under S.I. 2025/272. Any agency offering "review generation" should be able to explain how it stays inside paragraph 13.
Separately, CAP Code rule 3.7 requires marketers to hold documentary evidence for objective claims before they publish them. That covers your claims and the agency's own claims about itself.
Ecommerce marketing agencies in the UK
An ecommerce marketing agency usually combines Google Shopping, paid social, email and SEO for an online shop. The work starts with the product feed: titles, prices, stock and images that are correct everywhere. Prices in the feed are ads, so CAP Code rule 3.18 on including VAT and charges applies. Our guide to ecommerce digital agencies covers the capability stacks in detail.
Agencies by city
Where you buy matters less than who does the work, but local knowledge helps for some jobs. Our city guides: digital marketing in London, Manchester, Leeds, Bristol, Glasgow and Cardiff.
Digital marketing and PPC in the UK: questions buyers ask
Should a UK business pay a percentage of ad spend or a flat fee?
A percentage rises with your budget whether or not the work grows. A flat fee is easier to plan. A hybrid sets a base fee with a review point as spend grows. Whichever you choose, ask for the fee and the media spend as separate lines.
Do UK agencies have to include VAT in their quotes?
Agencies selling to businesses often quote without VAT. CAP Code rule 3.18 allows VAT exclusive prices only where the buyers addressed can recover VAT or pay none, with the VAT stated prominently. Ask for every quote to say clearly whether VAT is included.
Can an agency buy reviews for us?
No. Commissioning fake reviews is banned under Schedule 20 of the DMCC Act 2024. An agency can help you ask genuine customers for reviews, and if you offer an incentive, the CAP Code says that must be made clear.
Do we need a London agency to compete nationally?
No. Many strong UK agencies are based outside London and work for national brands. Judge the people and the results they can show for businesses like yours.
When can we judge whether an agency is working?
Read cost per enquiry or cost per sale in the Google Ads and Meta ads accounts, conversions by source in your analytics, and Search Console for SEO. Agree the numbers and review date before work starts. The outcome depends on competition, your offer and your budget.
Who a UK buyer is told to call
A buyer asking ChatGPT or Gemini "which PPC agencies in the UK work with ecommerce brands" gets a few names, chosen from agency sites, award lists, directories and press coverage. The firms named are not always the ones on page one of Google. AI Knows Us asks those buyer questions on ChatGPT, Gemini, Perplexity, Claude and Google AI Overviews and shows which firms are named and which sources each answer used, which tells an agency or a brand where it is missing from the conversation.
