How a foreign company wins Canadian customers without a Canadian office, and the five checks a Canadian buyer runs
The trust gap as five concrete checks, what each costs to satisfy, and the two situations where a Canadian entity really is required.

A foreign company can win Canadian customers without an office in Canada, and the barrier is not geography. It is five specific checks a Canadian buyer runs, usually without saying so. Can I pay you in Canadian dollars with the right tax on the invoice. Who do I call, and in which hours. What happens legally if this goes wrong. Can you serve Quebec in French. And is there anybody like me who has already bought from you. Satisfy those five and the absence of a Canadian office stops mattering for most private sector categories. Fail any one and a lower price will not rescue the deal.
The five checks, and what each costs
| The buyer's check | What satisfies it | Rough cost to you |
|---|---|---|
| Can I pay you properly? | Canadian dollar invoicing, correct provincial tax with a registration number, electronic funds transfer or card, stated terms | Low. A processor and an accountant's half day |
| Who do I call? | Named hours overlapping the Canadian business day, a Canadian number, a named human | Moderate. The number is cheap, the staffed hours are not |
| What if it goes wrong? | Governing law and venue Canadian counsel will accept, plus insurance evidence | Moderate. Legal review once, then reusable |
| Can you serve Quebec? | French written for a Quebec reader, and a statement of how Charter requirements are met | Real, and it is the check most foreign suppliers fail |
| Has anybody like me bought? | Two Canadian references in the buyer's sector, contactable | Low in money. Price the first two deals as reference deals |
The two situations where a Canadian entity really is required
- Public sector and institutional procurement. Federal, provincial, municipal, university and hospital buying processes frequently require a Canadian entity, registration and a tax identification number before a bid is accepted.
- Licensed categories. Insurance, certain financial services and some trades are licensed provincially, and the licence attaches to an entity and often to a person. No amount of trust building substitutes for it.
Outside those two, the entity question is a tax and payments question rather than a sales one, and it should be answered by an accountant rather than by a growth plan. Satisfy the preference first, win private sector work, and incorporate when a required buyer is actually in front of you.
The Canadian rules that apply to you anyway
Selling into Canada from outside it does not put you outside Canadian marketing law when you market to Canadians. CASL applies to commercial electronic messages sent to Canadian recipients, requiring consent, clear sender identification and a working unsubscribe honoured promptly, with the CRTC enforcing. The Competition Act's misleading representations provisions, administered by the Competition Bureau and amended in 2024, govern the claims a Canadian buyer sees, with a private right of access to the Competition Tribunal for certain deceptive marketing conduct arriving in June 2025. Quebec's Charter of the French Language, strengthened in 2022, reaches commercial advertising and public communications in that province. Privacy follows the data, with PIPEDA federally, Quebec's Law 25, and the Alberta and British Columbia statutes.
The practical version is one named Canadian reviewer who reads every claim, every consent flow and every French asset before it ships. That role is cheap and it is the difference between a market entry and a retraction.
What Canadian buyers are told when they ask, measured
On 22 October 2026 we put a 198 question Canadian buyer bank in 33 batches to the ChatGPT and Gemini product surfaces through a data provider, with Canada named inside the text of each question because the provider accepts gl, hl and location parameters and ignores all three. Batch 33 names us in the question and measures a ceiling, excluded from every figure. Sixty four blind readings, 32 per engine, 2,992 citation URLs across 974 distinct hosts.
The engines named six Canadian agencies unprompted, 21 namings in total, with Major Tom in 8 readings and Konstruct in 6, and they named no overseas agency at all. Software took 48 namings, led by Semrush at 16, HubSpot at 12 and Ahrefs at 9, and most of those products are not Canadian companies. Thirty three of the 64 readings named nobody at all.
That pattern is useful to a foreign seller. The locality preference in Canada appears in the services answers and not in the software answers, so whether being foreign costs you visibility depends on which category you are in. And the 38 unclaimed readings are open to whoever publishes the clearest, most checkable, dated answer, regardless of where they are registered.
The order to do this in
- Fix the invoice first. Canadian dollars, correct provincial tax with a registration number, a payment method a Canadian bank accepts, and the agreed terms.
- Publish Canadian support hours and a Canadian number, and staff the overlap honestly rather than aspirationally.
- Get the contract reviewed once for Canadian buyers, then reuse it. Governing law and venue are what procurement reads.
- Decide the Quebec question. If you sell there, buy French writing in Canada and say so plainly on the site.
- Appoint the Canadian claim and consent reviewer before the first campaign.
- Win two Canadian references and make them contactable.
If the Quebec half is the gap, the French requirement and the privacy law touching your tracking are set out in French first by law, and Law 25 on your tracking. If the invoice and entity question is the one you need settled, it is costed in what it costs a supplier to provide one.
Questions foreign sellers ask about the Canadian market
Do I need a Canadian entity?
For most private sector categories, no. For public sector and institutional procurement and for licensed categories, usually yes. Treat it as a tax, payments and licensing question and take advice.
Can I ignore Quebec?
Only if you genuinely do not sell there, and say so internally in writing. If you do, French written for a Quebec reader is a requirement rather than a preference.
Is a Canadian phone number enough?
It removes a friction and does not substitute for staffed hours. A number reaching voicemail during Canadian business hours is worse than no number.
How do I get the first two Canadian references?
Price the first two deals as reference deals with the reference written into the agreement. It is the cheapest marketing expenditure available to an entrant.
Do assistants favour Canadian suppliers?
In the services answers, yes on our evidence, with six Canadian firms named 21 times and no overseas agency named. In the software answers, mostly foreign products. It depends on the category rather than on registration.
The queue where a foreign supplier is not structurally behind
Most of the Canadian trust gap is about payment, support, contract and French. The assistant queue is different, because 38 of our 64 Canadian readings named nobody at all, so the slot is open to whoever publishes the clearest checkable answer. AI Knows Us reads ChatGPT, Gemini, Perplexity, Claude and Google AI Overviews with Canada named inside the question, reports each engine separately with its denominator, and keeps the raw answer text. Outside the United States and the United Kingdom the cheapest plan that reads all five engines is Growth at 199 dollars a month with 100 buyer questions watched, read on aiknowsus.com/pricing and aiknowsus.com/llms.txt on 22 October 2026.
