SEO and marketing agencies in Nigeria: ARCON licensing, the Data Protection Act and how to check a firm before you sign
How a Nigerian business should buy SEO, social media, PPC and advertising work, built on ARCON's licensing and vetting rules, the NDPC's 2025 directive, the FCCPA and the FCT signage department, read on 22 October 2026.

To hire an SEO agency or a marketing agency in Nigeria, check four things before price: the firm's ARCON licence and the area of advertising it covers, its company record at the Corporate Affairs Commission, how it will handle your customers' data under the Nigeria Data Protection Act 2023, and a written list of the work it will do each month on Google, Facebook and Instagram. Google handles more than 98% of searches in Nigeria, so SEO here means Google SEO. Advertising is a regulated profession, with licensed practitioners and pre-exposure vetting of adverts. A good agency explains both rules to you, keeps every account in your company's name, and never promises a ranking.
The market an agency in Nigeria is working in
StatCounter's September 2026 figures for Nigeria show Google with 98.28% of search and Bing with 1.41%. On social media, Facebook sends 87.51% of the visits that social networks send to websites, Instagram 4.31%, YouTube 3.19%, X (Twitter) 3.03% and LinkedIn 0.75%. For most Nigerian businesses that settles the channel mix: Google search and the Business Profile for people who are ready to buy, Facebook and Instagram for reach, and LinkedIn mainly for business-to-business sales.
The figures count clicks to websites. They miss the conversations that move straight into WhatsApp, so ask any agency how it will count those enquiries before you agree what success means.
Advertising in Nigeria is a licensed profession
The Advertising Regulatory Council of Nigeria (ARCON) regulates the advertising business. Its practice guidelines say that firms which carry on the business of advertising for profit "shall be licensed by ARCON, with the exclusion of advertisers", that the licence is "renewable every three years", and that each firm's area of specialisation is defined and sets the scope of its licence. The same guidelines separate a national agency from a foreign agency by Nigerian ownership, and say a foreign agency "shall practice advertising targeted at market outside the shores of Nigeria".
ARCON also vets adverts before they run. Its vetting page says it insists on "pre-exposure clearance of all advertisements" to check misleading statements, spurious testimonials and exaggeration, that the advertising practitioner makes the application, and that an advert in the vetting category should not be exposed until a Certificate of Approval from the Advertising Standards Panel has been received. The panel meets monthly, and accelerated vetting is offered at 4, 8 and 16 working hours. Put the vetting step in your campaign calendar and in your contract.
The Nigeria Data Protection Act and your marketing
The Nigeria Data Protection Commission's General Application and Implementation Directive (GAID 2025) spells out how the 2023 Act applies day to day. The parts a marketing agency touches:
- Consent for direct marketing. The GAID says consent is required "for any direct marketing activity". An email list, an SMS blast or a WhatsApp broadcast built from your leads needs that consent recorded.
- Cookie banners. Cookies other than strictly necessary ones need a clear yes or no choice, and the GAID says a visitor "shall not be required to scroll to any part of a website before seeing the cookie banner". A banner tucked at the bottom of the page is, in its words, "tantamount to lack of transparency".
- Objections and erasure. A person can have their data erased when they object to processing for direct marketing.
- Bigger data users. Organisations the Commission designates as data controllers or processors "of major importance" must register, appoint a Data Protection Officer and file annual compliance audit returns.
Your agency will add tags, pixels and forms to your site. Agree in writing who sets up the banner, who keeps the consent records, and that the agency processes your customers' data only on your instructions.
Consumer law: misleading claims and sales promotions
Section 123 of the Federal Competition and Consumer Protection Act 2018 bars misleading representations about a service and any guarantee to "continue the service until it has achieved a specified result" where the promise is materially misleading or has no reasonable prospect of being kept. Read a ranking guarantee in that light. Google's own page on hiring an SEO says "No one can guarantee a #1 ranking on Google."
The Federal Competition and Consumer Protection Commission also lists, among business obligations, that businesses must "register all sales promotions with the Commission". On 30 September 2026 it published the Draft Sales Promotion (Amended) Regulations, 2026 for public comment; the draft amends the 2005 regulations and changes notification fees. If your social media plan includes giveaways or contests, ask your agency who files them and under which version of the rules.
What an SEO agency in Nigeria should list, service by service
| Service | What the proposal should name |
|---|---|
| SEO | Pages written or improved each month, technical fixes and who makes them, Business Profile work, where links come from |
| Social media | Posts and ads per platform, who approves copy, how giveaways are registered, how WhatsApp enquiries are counted |
| Google Ads (PPC) | Ad account in your company's name, the media budget kept separate from the fee, and Google's 7.5% VAT on Nigerian billing addresses, charged since 1 April 2022 |
| Content marketing | Topics, writers, fact checks, and who owns the files when the contract ends |
| Outdoor and media buying | ARCON vetting, the state signage permit, and whose name each permit is in |
Before any call, search the firm on the Corporate Affairs Commission's registry, which lets you search or verify a business. Then ask for the ARCON licence and check that its area covers the work you are buying.
City by city: Lagos, Abuja and the rest of Nigeria
Lagos. Outdoor advertising there runs through the Lagos State Signage and Advertisement Agency, with its own permit categories for shop signs, billboards, branded vehicles and temporary ads. Our guide to hiring SEO companies and advertising agencies in Lagos covers those permits and local search across Ikeja, Lekki and the island.
Abuja. In the Federal Capital Territory, the FCT Outdoor Advertisement and Signage Department regulates "the business and practice of out of home advertisement", including the display of signage at malls, plazas, shops and other business premises, from its office in Jahi. ARCON runs an Abuja operations office in Utako, and the FCCPC's head office is in Asokoro. A digital marketing agency in Abuja should name which of these offices it deals with for your work.
Ibadan, Port Harcourt, Owerri, Warri and Kogi. The federal rules above apply everywhere: ARCON licensing and vetting, the Data Protection Act and the FCCPC. Signage permits are local, so for a billboard or shop sign ask the agency which body issues permits where the sign will stand, and ask for the permit in writing. For search, the work is the same as anywhere: a Business Profile at your real address, pages for each service and area you serve, and reviews that name both.
Questions about hiring an SEO or marketing agency in Nigeria
Can a foreign agency run our advertising in Nigeria?
ARCON's licensing guidelines say a foreign agency, as defined by ownership, "shall practice advertising targeted at market outside the shores of Nigeria". For campaigns aimed at Nigerians, ask which licensed Nigerian firm is responsible for the work and the vetting.
Does the Data Protection Act apply to a small business website?
Yes. If the site collects names, emails or phone numbers, or sets marketing cookies, the GAID's rules on consent and cookie banners apply. Registration and audit returns are aimed at organisations designated as of major importance.
Do social media ads need ARCON approval?
ARCON says it insists on pre-exposure clearance of all advertisements. Ask your agency which of your planned ads fall in the vetting category and to show you the certificates.
Is an Abuja agency different from a Lagos one?
The federal rules are the same. Outdoor permits differ: LASAA in Lagos, the FCT Outdoor Advertisement and Signage Department in Abuja.
When can we judge whether our agency's work is paying off?
Read Search Console for impressions and positions, the Business Profile performance report for calls, Ads Manager and Google Ads for cost per enquiry, and your own log of WhatsApp enquiries by source. The outcome depends on competition, your offer and your budget.
The answer a Nigerian buyer gets from an AI assistant
Ask ChatGPT for the best SEO agency in Nigeria and it can answer with a short list of names, built from directory pages, agency sites and articles it can read. That list is not the Google results page and it changes between assistants, so a firm that ranks well can still be missing. It is worth asking the same buyer questions yourself, leaving your own name out of the prompt. AI Knows Us is built for that job: it asks a business's real buyer questions on the main AI apps and reports who gets named and which sources the answers lean on.
